Terms of Service

These Terms of Service ("Terms") are an agreement between you and Addison ("we", "us") governing your use of the Addison service, which automatically sends a text message reply when a call to your business phone number is missed (the "Service"). By creating an account you agree to these Terms and our Privacy Policy.
1. The Service
We provide you with a business phone number (or connect an existing one) and send an automated SMS reply, using message content you control, to people whose calls to that number go unanswered. Incoming calls are forwarded to the business phone number you provide. You can edit your text-back message at any time in your account.
2. Eligibility and accounts
The Service is for business use by people 18 or older who can bind their business to these Terms. You are responsible for the accuracy of your account information, for keeping your password confidential, and for activity under your account.
3. Free trial, billing, and cancellation
New accounts start with a 14-day free trial. A payment method is collected at signup through our payment processor, Stripe; we do not store your card number. Unless you cancel before the trial ends, your card is charged $99 per month, and the subscription renews monthly until canceled. You can update your payment method or cancel at any time from Billing in your account; cancellation takes effect at the end of the current billing period unless stated otherwise at cancellation. Fees are non-refundable except where required by law or expressly stated by us. If a payment fails, we may retry it, and we may suspend the Service until it is resolved.
4. Capacity and waitlist
We limit the number of active accounts. If we are at capacity when you sign up, your account is placed on a waitlist and activated when a seat opens. You are not charged for the Service until it is activated.
5. Your responsibilities for text messaging
You agree that:
- The Service will be used only to reply to people who have called your business number, and only for the purpose of following up on that call. Do not use it for marketing, promotions, or unsolicited messages.
- Your message content will be lawful, accurate, and will identify your business. It will not be deceptive, harassing, sexually explicit, or related to prohibited content or activities under carrier and messaging-provider policies.
- You are responsible for complying with all laws and industry rules that apply to your messages, including the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and similar laws in the places where your customers are located.
- You will honor opt-outs. When a recipient replies STOP (or a similar opt-out keyword), no further messages will be sent to them from that number by the Service.
We may block, filter, or suspend messaging that we believe violates these Terms, applicable law, or carrier requirements, and we may share compliance-related information with our messaging providers and carriers as needed.
6. Messaging program terms for message recipients
If you received a text from a business that uses Addison: the message was sent automatically because you called that business and the call was missed. You will typically receive one automated message per missed call. Message and data rates may apply. Reply STOP to opt out of further messages from that number, or HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how phone numbers are handled.
7. Acceptable use
You will not use the Service for anything unlawful, to interfere with or attempt to gain unauthorized access to the Service or other accounts, or to resell or provide the Service to third parties without our written permission.
8. Third-party services
The Service relies on third-party providers (for example, telephony and SMS, payments, and email delivery). We are not responsible for outages or changes in those services, although we will work to minimize the impact on you.
9. Suspension and termination
You may cancel at any time. We may suspend or terminate your account if you breach these Terms, if a payment cannot be collected, or if needed to comply with law or carrier requirements. After termination, your text-back number may be released and your data deleted or retained as described in our Privacy Policy.
10. Disclaimers
The Service is provided "as is" and "as available." We do not guarantee that every missed call will trigger a message or that every message will be delivered — delivery depends on carriers and factors outside our control. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim.
12. Indemnification
You will defend and indemnify us against claims, losses, and expenses (including reasonable legal fees) arising from your message content, your use of the Service in violation of these Terms or applicable law, or your failure to honor a recipient's opt-out.
13. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or in your account. Continuing to use the Service after the effective date means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the state in which Addison is headquartered (as shown in the mailing address below), without regard to conflict-of-law rules. Courts located in that state will have exclusive jurisdiction, except where prohibited by law.
